These Terms of Use ("Terms") govern your use of the YourHomeschool family of websites, applications, and services — including homeworktutors.ai, yourhomeschool.net, homeskooltutor.com, our mobile apps, and any other website, app, or program we operate that links to these Terms (together, the "Service"). "We," "us," and "our" mean the operator of the Service.

The short version: Our tutors teach — they don't do the work for you. Use the Service honestly and only for schoolwork, keep your account safe, don't copy our content or abuse the AI, and understand that AI answers can be wrong. Disputes are resolved individually through arbitration. Parents accept these Terms for children under 13.

1. Acceptance of these Terms

By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If a student is under 13 (or the age of digital consent where you live), a parent or legal guardian must review and accept these Terms on the student's behalf and is responsible for the student's use of the Service.

2. What the Service is — and isn't

The Service is an educational aid: AI tutoring (photo, text, and voice), quizzes, lesson videos, workbooks, and related learning tools. It supplements teachers, schools, and parents — it does not replace them.

About AI-generated content: Tutoring replies, corrections, quiz questions, and other AI outputs are generated automatically. They may contain errors or omissions, may not be unique to you, and are provided for learning support only. They are not professional, legal, medical, or educational-placement advice. You (and, for minors, your parent or guardian) are responsible for how you use, share, or rely on outputs. Always double-check important work.

3. Eligibility & accounts

Students of any age may use the Service; users under 13 must have a parent or guardian set up and supervise their use, and users under 18 must have a parent or guardian's permission.
Purchases and subscriptions may only be made by an adult (18+, or the age of majority where you live).
Account sign-in is passwordless (an emailed magic link). You are responsible for your email account's security and for all activity under your account. Give us accurate information and keep it current.
We may suspend or terminate accounts created with false information or used in violation of these Terms.

4. Free tier, subscriptions & payment

Free tier: a set number of free questions per day (currently 3) per person/device, resetting daily. We may adjust the free tier's size or mechanics at any time.
Premium: an auto-renewing subscription (currently $6/month or $60/year). On the web, billing is via Stripe; in mobile apps, via Apple or Google in-app purchase. Your subscription renews automatically until you cancel.
Cancel anytime: on the web through the billing portal; in the apps through Google Play › Subscriptions or Settings › Apple ID › Subscriptions. Cancellation stops future renewals; periods already paid for remain active until they end and, except where required by law or by the app store's own policy, fees already paid are non-refundable.
Price changes: we will give at least 30 days' notice before a subscription price increase takes effect for you.
Purchases made through Apple or Google are also subject to their terms, and refunds for those purchases are handled by them.

5. Acceptable use

You agree that you will not:

use the Service for anything other than legitimate schoolwork and learning;
upload content that is unlawful, infringing, hateful, sexually explicit, violent, or that invades another person's privacy — or any photo of a person where you lack the right to share it;
attempt to jailbreak, bypass, or defeat the tutor's safety systems, content filters, schoolwork-only guardrails, or usage metering (including cycling devices or identities to obtain extra free questions);
scrape, harvest, bulk-download, or systematically extract content, outputs, questions, videos, or data from the Service;
use the Service or its outputs to build, train, fine-tune, or improve a competing product or dataset;
reverse engineer, decompile, or copy the Service or its software except where the law expressly permits;
resell, rent, or redistribute the Service or access to it without our written permission;
interfere with the Service's operation or other users' enjoyment of it, probe or test vulnerabilities, or impose an unreasonable load on our infrastructure;
impersonate any person or misrepresent your affiliation.

We may monitor for abuse and may remove content or restrict, suspend, or terminate access for violations.

6. Your content

You own your content (homework photos, questions, messages, voice input). You grant us a limited, non-exclusive, worldwide license to host, process, transmit, and display it solely to operate and provide the Service to you (for example, sending your photo to our AI provider so the tutor can read it).
We do not use your content to train AI models, we do not sell it, and homework photos are never stored — see the Privacy Policy. This narrow license ends when the processing ends, except for the minimal records we describe there.
You are responsible for your content — including having the right to share it.

7. Our intellectual property

The Service — including its software, design, branding, logos, characters, lesson videos, workbooks, curricula, question banks, and all other content we provide (except your content) — is owned by us or our licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-transferable, non-commercial, revocable license to use the Service as intended. No other rights are granted. Printed workbook QR codes and lesson pages are for the book owner's personal educational use.

8. Third-party services

The Service relies on third-party providers (for example: AI model providers, text-to-speech, payment processors, app stores, hosting). Their services are governed by their own terms, and we are not responsible for third-party services we do not control.

9. Copyright complaints (DMCA)

If you believe content on the Service infringes your copyright, send a notice under 17 U.S.C. §512 to support@homeworktutors.ai (subject "DMCA") including: your contact information; identification of the work and of the allegedly infringing material (with its location); a statement of good-faith belief that use is unauthorized; a statement, under penalty of perjury, that the notice is accurate and you are authorized to act; and your physical or electronic signature. We respond to valid notices, may remove material, and terminate repeat infringers. Counter-notices may be sent to the same address.

10. Termination

You may stop using the Service at any time and may request account deletion via support@homeworktutors.ai. We may suspend or terminate your access (with notice where practicable, immediately for serious violations) if you breach these Terms, if required by law, or if we discontinue the Service. Upon termination for your breach, fees already paid are non-refundable. Sections 2, 6–9, and 11–15 survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED — INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT OUTPUTS WILL BE ACCURATE, ORIGINAL, OR SUITABLE; OR THAT USE OF THE SERVICE WILL PRODUCE ANY PARTICULAR ACADEMIC RESULT, GRADE, OR OUTCOME. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL; AND (b) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED U.S. DOLLARS ($100). These limits do not apply to liability that cannot be limited by law (such as for fraud, or death or personal injury caused by negligence), and do not affect consumer rights that cannot be waived where you live.

13. Indemnification

To the extent permitted by law, you (and, for a minor user, the accepting parent or guardian) agree to indemnify and hold us, our affiliates, and our officers, employees, and agents harmless from losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: your content; your use or misuse of the Service or its outputs; your violation of these Terms or of any law; or your violation of any third party's rights. This obligation survives termination.

14. Dispute resolution — arbitration & class action waiver

Please read this section carefully — it affects your legal rights.

Talk to us first. Before filing any claim, email support@homeworktutors.ai with a description of the dispute. We'll try in good faith to resolve it informally within 60 days.
Binding arbitration. If we can't resolve it informally, any dispute arising out of or relating to the Service or these Terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. You and we each waive the right to a trial by judge or jury.
Class action waiver. All claims must be brought on an individual basis only — not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding, and the arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is found unenforceable for a particular claim, that claim (and only that claim) must proceed in court.
Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual property.
30-day opt-out. You may opt out of this arbitration agreement by emailing support@homeworktutors.ai (subject "Arbitration opt-out") within 30 days of first accepting these Terms, stating your name and account email. Opting out does not affect any other part of these Terms.
Governing law. These Terms are governed by the laws of the State of Washington, USA, and applicable U.S. federal law, without regard to conflict-of-law rules — except where the law of your place of residence gives you rights that cannot be waived.

15. General

Changes to these Terms: we may update these Terms; for material changes we will give at least 15 days' notice (in the app, on the site, or by email). Continued use after the effective date is acceptance. Changes to Section 14 allow a new 30-day opt-out.
Availability & changes to the Service: we may change, suspend, or discontinue features (including the free tier's size) at any time.
If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale. These Terms and the Privacy Policy are the entire agreement between us regarding the Service. We are not liable for delays or failures caused by events beyond our reasonable control.

1. Aceptación de estos Términos

Al usar el Servicio usted acepta estos Términos y nuestro Aviso de Privacidad. Si no está de acuerdo, no use el Servicio. Si un estudiante tiene menos de 13 años (o la edad de consentimiento digital de su lugar de residencia), un padre o tutor legal debe revisar y aceptar estos Términos en su nombre y es responsable del uso que el estudiante haga del Servicio.

2. Qué es el Servicio — y qué no es

El Servicio es un apoyo educativo: tutoría con IA (foto, texto y voz), quizzes, videos de lecciones, cuadernos de trabajo y herramientas de aprendizaje relacionadas. Complementa a maestros, escuelas y padres — no los reemplaza.

Sobre el contenido generado por IA: Las respuestas del tutor, correcciones, preguntas de quiz y demás resultados de IA se generan automáticamente. Pueden contener errores u omisiones, pueden no ser únicos para usted y se ofrecen solo como apoyo al aprendizaje. No constituyen asesoría profesional, legal, médica ni de colocación educativa. Usted (y, en el caso de menores, su padre o tutor) es responsable de cómo usa, comparte o se apoya en los resultados. Verifique siempre el trabajo importante.

3. Elegibilidad y cuentas

Estudiantes de cualquier edad pueden usar el Servicio; los menores de 13 necesitan que un padre o tutor configure y supervise su uso, y los menores de 18 necesitan permiso de un padre o tutor.
Las compras y suscripciones solo pueden hacerlas adultos (18+, o la mayoría de edad de su lugar de residencia).
El acceso es sin contraseña (un enlace mágico por correo). Usted es responsable de la seguridad de su correo y de toda la actividad de su cuenta. Proporcione información veraz y manténgala actualizada.
Podemos suspender o cerrar cuentas creadas con información falsa o usadas en violación de estos Términos.

4. Nivel gratuito, suscripciones y pago

Nivel gratuito: un número fijo de preguntas gratis al día (actualmente 3) por persona/dispositivo, que se restablece cada día. Podemos ajustar el tamaño o el funcionamiento del nivel gratuito en cualquier momento.
Premium: una suscripción con renovación automática (actualmente $6/mes o $60/año). En la web se cobra vía Stripe; en las apps móviles, vía compra dentro de la app de Apple o Google. Su suscripción se renueva automáticamente hasta que la cancele.
Cancele cuando quiera: en la web desde el portal de facturación; en las apps desde Google Play › Suscripciones o Configuración › Apple ID › Suscripciones. Cancelar detiene renovaciones futuras; los periodos ya pagados siguen activos hasta terminar y, salvo que la ley o la política de la tienda lo exijan, los pagos ya realizados no son reembolsables.
Cambios de precio: avisaremos con al menos 30 días de anticipación antes de que un aumento de precio le aplique.
Las compras hechas a través de Apple o Google también se rigen por sus términos, y los reembolsos de esas compras los gestionan ellos.

5. Uso aceptable

Usted se compromete a no:

usar el Servicio para algo distinto de la tarea escolar y el aprendizaje legítimos;
subir contenido ilegal, infractor, de odio, sexualmente explícito, violento o que invada la privacidad de otra persona — ni fotos de personas que no tenga derecho a compartir;
intentar hacer "jailbreak", eludir o vencer los sistemas de seguridad del tutor, los filtros de contenido, la restricción de solo-tarea o la medición de uso (incluido rotar dispositivos o identidades para obtener preguntas gratis adicionales);
extraer, cosechar o descargar masiva o sistemáticamente contenido, resultados, preguntas, videos o datos del Servicio;
usar el Servicio o sus resultados para construir, entrenar, afinar o mejorar un producto o conjunto de datos competidor;
realizar ingeniería inversa, descompilar o copiar el Servicio o su software salvo donde la ley lo permita expresamente;
revender, rentar o redistribuir el Servicio o el acceso a él sin nuestro permiso escrito;
interferir con el funcionamiento del Servicio o con otros usuarios, sondear vulnerabilidades o imponer una carga irrazonable a nuestra infraestructura;
suplantar a ninguna persona ni falsear su afiliación.

Podemos vigilar abusos y podemos retirar contenido o restringir, suspender o terminar el acceso por violaciones.

6. Su contenido

Su contenido es suyo (fotos de tarea, preguntas, mensajes, voz). Usted nos otorga una licencia limitada, no exclusiva y mundial para alojarlo, procesarlo, transmitirlo y mostrarlo únicamente para operar y prestarle el Servicio (por ejemplo, enviar su foto a nuestro proveedor de IA para que el tutor la lea).
No usamos su contenido para entrenar modelos de IA, no lo vendemos, y las fotos de tarea nunca se guardan — vea el Aviso de Privacidad. Esta licencia estrecha termina cuando termina el procesamiento, salvo los registros mínimos descritos ahí.
Usted es responsable de su contenido — incluido tener el derecho de compartirlo.

7. Nuestra propiedad intelectual

El Servicio — incluidos su software, diseño, marca, logotipos, personajes, videos de lecciones, cuadernos, planes de estudio, bancos de preguntas y todo el demás contenido que proporcionamos (excepto su contenido) — es propiedad nuestra o de nuestros licenciantes y está protegido por derechos de autor, marcas y otras leyes. Le otorgamos una licencia limitada, personal, intransferible, no comercial y revocable para usar el Servicio según lo previsto. No se otorga ningún otro derecho. Los códigos QR y páginas de lección de los cuadernos impresos son para el uso educativo personal del dueño del libro.

8. Servicios de terceros

El Servicio depende de proveedores externos (por ejemplo: proveedores de modelos de IA, texto a voz, procesadores de pago, tiendas de apps, alojamiento). Sus servicios se rigen por sus propios términos, y no somos responsables de servicios de terceros que no controlamos.

9. Reclamaciones de derechos de autor (DMCA)

Si cree que algún contenido del Servicio infringe sus derechos de autor, envíe un aviso conforme a 17 U.S.C. §512 a support@homeworktutors.ai (asunto "DMCA") incluyendo: sus datos de contacto; identificación de la obra y del material presuntamente infractor (con su ubicación); una declaración de buena fe de que el uso no está autorizado; una declaración, bajo pena de perjurio, de que el aviso es exacto y usted está autorizado para actuar; y su firma física o electrónica. Respondemos a avisos válidos, podemos retirar material y cancelamos a infractores reincidentes. Las contranotificaciones se envían a la misma dirección.

10. Terminación

Puede dejar de usar el Servicio cuando quiera y solicitar la eliminación de su cuenta en support@homeworktutors.ai. Podemos suspender o terminar su acceso (con aviso cuando sea razonable; de inmediato ante violaciones graves) si incumple estos Términos, si la ley lo exige o si discontinuamos el Servicio. Si terminamos por su incumplimiento, los pagos ya realizados no son reembolsables. Las secciones 2, 6–9 y 11–15 sobreviven a la terminación.

11. Descargos de responsabilidad

EL SERVICIO SE PROPORCIONA "TAL CUAL" Y "SEGÚN DISPONIBILIDAD", CON TODOS SUS DEFECTOS Y SIN GARANTÍAS DE NINGÚN TIPO, EXPRESAS O IMPLÍCITAS — INCLUIDAS LAS GARANTÍAS IMPLÍCITAS DE COMERCIABILIDAD, IDONEIDAD PARA UN FIN PARTICULAR Y NO INFRACCIÓN. 12. Límite de responsabilidad

Estos límites no aplican a responsabilidades que la ley no permite limitar (como fraude, o muerte o lesiones personales causadas por negligencia) y no afectan derechos del consumidor irrenunciables en su lugar de residencia.

13. Indemnización

En la medida que la ley lo permita, usted (y, en el caso de un usuario menor, el padre o tutor que acepta) se compromete a indemnizarnos y mantenernos indemnes — a nosotros, nuestras afiliadas y nuestros directivos, empleados y agentes — frente a pérdidas, responsabilidades, costos y gastos (incluidos honorarios razonables de abogados) derivados de: su contenido; su uso o mal uso del Servicio o de sus resultados; su violación de estos Términos o de cualquier ley; o su violación de derechos de terceros. Esta obligación sobrevive a la terminación.

14. Resolución de disputas — arbitraje y renuncia a acciones colectivas

Lea esta sección con cuidado — afecta sus derechos legales.

Hable primero con nosotros. Antes de presentar cualquier reclamación, escriba a support@homeworktutors.ai describiendo la disputa. Intentaremos de buena fe resolverla informalmente en un plazo de 60 días.
Arbitraje vinculante. Si no se resuelve informalmente, cualquier disputa derivada del Servicio o de estos Términos se resolverá mediante arbitraje individual, definitivo y vinculante administrado por la American Arbitration Association (AAA) bajo sus Reglas de Arbitraje de Consumo, en lugar de en los tribunales. La Ley Federal de Arbitraje de EE. UU. rige esta sección. Ambas partes renuncian al derecho a un juicio ante juez o jurado.
Renuncia a acciones colectivas. Todas las reclamaciones deben presentarse únicamente a título individual — no como demandante o miembro de una acción de clase, colectiva, consolidada o representativa, y el árbitro no puede consolidar reclamaciones ni presidir ningún procedimiento representativo. Si esta renuncia resulta inaplicable para una reclamación en particular, esa reclamación (y solo esa) procederá en los tribunales.

Exclusión en 30 días. Puede excluirse de este acuerdo de arbitraje escribiendo a support@homeworktutors.ai (asunto "Arbitration opt-out") dentro de los 30 días siguientes a su primera aceptación de estos Términos, indicando su nombre y el correo de su cuenta. Excluirse no afecta el resto de estos Términos.
Ley aplicable. Estos Términos se rigen por las leyes del Estado de Washington, EE. UU., y la ley federal estadounidense aplicable, sin atender a normas de conflicto de leyes — salvo cuando la ley de su lugar de residencia le otorgue derechos irrenunciables.

15. Disposiciones generales

Cambios a estos Términos: podemos actualizarlos; para cambios importantes avisaremos con al menos 15 días de anticipación (en la app, en el sitio o por correo). Seguir usando el Servicio después de la fecha de vigencia constituye aceptación. Los cambios a la Sección 14 abren un nuevo plazo de exclusión de 30 días.
Disponibilidad y cambios del Servicio: podemos cambiar, suspender o descontinuar funciones (incluido el tamaño del nivel gratuito) en cualquier momento.
Si alguna disposición resulta inaplicable, las demás siguen vigentes. No hacer valer una disposición no es una renuncia. Usted no puede ceder estos Términos; nosotros podemos cederlos en una fusión, adquisición o venta. Estos Términos y el Aviso de Privacidad son el acuerdo completo entre las partes sobre el Servicio.
